1. Who we are
This website is operated by ATMOSBRAND LTD, a company registered in England and Wales (company number 17482638), registered office 20 Wenlock Road, London N1 7GU, England. In these terms, "we", "us" and "our" mean ATMOSBRAND LTD.
2. Accepting these terms
By browsing or using atmosliving.co, or by placing an order, you accept these terms. If you do not accept them, please do not use the site.
3. Using the site
You may use this site for lawful purposes only. You agree not to:
- use the site in a way that breaches any applicable law or regulation;
- attempt to gain unauthorised access to the site, its servers or any connected system;
- introduce malicious code or interfere with the site's normal operation;
- extract or reuse substantial parts of the site's content by automated means without our written consent.
4. Accounts
If you create an account, you are responsible for keeping your login details confidential and for activity carried out through it. Tell us promptly at support@atmosliving.co if you believe your account has been used without your permission.
5. Availability
We aim to keep the site available at all times but do not guarantee uninterrupted access. We may suspend, withdraw or restrict all or part of the site for business or operational reasons, giving notice where reasonably practicable.
6. Intellectual property
All intellectual property rights in the site and its content belong to us or our licensors. Nothing in these terms transfers any of those rights to you.
7. Links to other sites
Where we link to third-party websites, those links are provided for information only. We have no control over their content and accept no responsibility for it.
8. How a contract is formed
Placing an order is an offer to buy. We send an acknowledgement email when we receive it; that email is not acceptance. A contract is formed only when we send an email confirming dispatch. If we cannot supply an item, we will tell you and refund any payment taken.
9. Prices and taxes
Prices are shown in US dollars and include applicable taxes where stated at checkout. Delivery charges are shown separately before you pay.
For deliveries outside the country of dispatch, import duties or taxes may be charged on arrival. These are set by the destination country and are your responsibility as the importer of record.
10. Payment
Payment is taken at the time of order through the payment methods offered at checkout. Card details are handled by our payment providers; we do not store full card numbers.
11. Delivery
Delivery timescales and charges are set out in our Shipping and delivery policy. Risk in the goods passes to you on delivery; ownership passes once we have received payment in full.
12. Your right to cancel
If you are a consumer in the UK or EU, you may cancel your order within 14 days of receiving the goods, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
To cancel, email support@atmosliving.co with your order number. Return the goods within 14 days of telling us. We refund within 14 days of receiving them back, or of proof that you sent them.
You may handle goods as you would in a shop. If you handle them beyond that and their value is reduced, we may deduct that reduction from your refund.
13. Our 100-day trial
We also offer a 100-day trial and free returns within it, described in our Refund and returns policy. That offer is in addition to your legal rights and does not replace them.
14. Faulty or misdescribed goods
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If they are not, you have a short-term right to reject within 30 days of delivery, and thereafter a right to repair or replacement. Contact us and we will arrange collection at our cost.
15. Our liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited. We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms.
We provide this site and our products for private and domestic use. We are not liable for business losses, including loss of profit, business or opportunity. Your statutory rights as a consumer are not affected.
16. Complaints
Write to support@atmosliving.co. We acknowledge complaints within one working day and aim to resolve them within 14 days.
17. Changes
We may amend these terms from time to time. The version published on this page applies to your use of the site, and to orders placed, on that date.
18. Governing law
These terms are governed by the law of England and Wales, without affecting the protection of the mandatory consumer law of your country of residence. Disputes may be brought before the courts of England and Wales; if you live in Scotland or Northern Ireland you may also bring proceedings in your own jurisdiction.
